This Privacy Policy, Terms of Service, and Use Agreement (“Agreement”) contains important information about the privacy policies and terms of service and use related to visiting The Briggs Institute, Inc. websites, including the www.sexlifescience.com website (“Website”), and taking The Sex Test by Sex Life Science (“Test”). It also contains information about privacy protections for your personal information and potential risks to your confidentiality. Although this document is long and sometimes complex, it is very important that you read it carefully before using the Website and/or taking the Test. If you have any questions, you can contact The Briggs Institute, Inc. using the contact information available at www.sexlifescience.comwww.jgregorybriggs.com, or at www.thebriggsinstitute.com. By using the Website and/or taking the Test, you agree to fully comply and adhere to this Agreement. 

PROVISIONS SUBJECT TO CHANGE

Please note that The Briggs Institute, Inc. may change the terms of this Agreement without notice and the changes will apply to all information we have about you. The new provisions will be available online and upon request. We recommend checking this Agreement frequently for any such changes; your continuing to use the Website shall constitute your legally binding acceptance of any changes made to the Agreement. 

DEFINITIONS

“Sex Life Science” is a part of The Briggs Institute, Inc., a privately owned business located in Nashville, TN. Sex Life Science is its own entertainment and informational service and is not connected to the psychotherapy services provided by the clinicians at The Briggs Institute, Inc.

“Sex Life Science Services” or “Services” include all website content and tests. 

“Visitors” and “Users” are those people who access the Website and/or take the Test. 

“Website” represents all content (text, images, etc.) available at www.sexlifescience.comwww.jgregorybriggs.com, and www.thebriggsinstitute.com and their various subpages.

“Test” is The Sex Test by Sex Life Science, an interactive online tool owned and operated by The Briggs Institute, Inc. This tool is meant for entertainment and informational purposes only and is not to be confused with a psychological or medical assessment like those one may take in a psychotherapy session or medical office visit. 

INTENDED AUDIENCE

The Website is not directed at children under the age of 18. The Briggs Institute, Inc. does not knowingly allow anyone under 18 years of age to submit personal information on the Website or the Test. 

INTENDED PURPOSE

The Website and the Test are meant for entertainment and informational purposes only and should not be used for psychological or medical assessment and/or treatment purposes. This test is not a substitute for professional diagnosis or for the treatment of any health condition. All of us at The Briggs Institute Inc. and Sex Life Science recommend that you seek the advice of a licensed mental health and/or medical professional if you have questions about your mental health, relationships, or sexual functioning. If you are having thoughts of suicide or self/other harm, or are the victim of abuse or domestic violence, please call 911 (if in the United States) and/or contact emergency services immediately. 

PROTECTED MATERIAL

All material appearing on the Site and Test is protected and is the property of The Briggs Institute, Inc. or the party credited as the provider of the content. Copying, reproducing, distributing, publishing, displaying, performing, modifying, creating derivative works, transmitting, or in any way exploiting any such content is prohibited. Distributing any part of this content over any network, including a local area network, selling or offering it for sale, or using such content to construct any kind of database is also prohibited. No one may alter or remove any copyright or other notice from copies of the content on the Site or Test. Copying or storing any content except as provided above is expressly prohibited without prior written permission of an authorized representative of The Briggs Institute, Inc. or the copyright holder identified in the individual content’s copyright notice. For permission to use the content on the the Site or Test, please contact The Briggs Institute, Inc.

SUBPOENAS

The Briggs Institute, Inc. does not disclose the identities of visitors or users of the Website unless legally required to release such information. Whenever we are allowed to do so by law, we will attempt to give prior notice to any named party in a subpoena received by us from any party, governmental or private, requiring us to disclose your name and/or any additional information you submit on the Website. 

HOW WE USE YOUR INFORMATION

Sex Life Science collects information from users when they visit the Website, when they pay for the Test, and when they provide answers on the Test. All identifiable information (e.g., name, credit card number, etc.) provided by users is connected to a membership account and payment. The Sex Test by Sex Life Science does not collect any personally identifiable information from users. The Test does ask users to provide demographic information such as gender and sexual orientation, but this type of information does not allow us to connect test responses to a user’s identity (i.e., name, payment information) with 100% confidence. 

The Briggs Institute, Inc. may use your account and billing information and test responses as we run our organization; market our services; analyze website activity; bill for your services; help with public health and safety issues; do research; comply with the law; address workers’ compensation, law enforcement, and other government requests; and respond to lawsuits and legal actions. In any written reports or publications, you will not be identified or identifiable and only group data will be presented. Except in extraordinary circumstances (see “Subpoenas” for more details), we do not share your identifiable information with anyone outside of The Briggs Institute, Inc. other than our billing partners (e.g., credit card payment partners). 

HOW WE PROTECT THE ANONYMITY OF TEST RESPONSES

It is impossible to guarantee the confidentiality and anonymity of information transmitted over the internet; however, we have taken several steps to greatly reduce the likelihood of a confidentiality and anonymity breach of user data. Once users pay for the test, they are taken to a separate part of the site, the Test page, and their test is assigned a test ID number. The test itself and your responses are managed by our partners at Qualtrics. Payment information (which is identifiable) and test information (which is not identifiable) are collected and stored separately, making it impossible for Qualtrics to identify a test taker’s identity. As a point of policy, no one at The Briggs Institute, Inc. does a side-by-side comparison of test responses and membership or financial data, which could possibly allow one to deduce the identity of a test taker based on the time of purchase and a test taker’s demographic information; however, due to many factors (e.g., multiple test submissions within short time frames), even a violation of this policy would not always allow someone at The Briggs Institute, Inc. to determine test taker identities with absolute certainty. Only those who take the test are able to connect their test ID with their identity with absolute certainty. 

After taking the Test, users access their test results by inputting their test ID into the results dashboard. If users forget their test ID, The Briggs Institute, Inc. will not be able to look it up for them because we do not collect information that allows us to connect a test ID to a user’s identity. 

Due to the anonymous nature of test responses, we are not able to comply with user requests to have their test responses removed from our database. 

LIMITS ON CONFIDENTIALITY

Because users are the only people who can connect a test ID with their identity, limits on confidentiality and anonymity of test results are primarily related to whether or not a user decides to share their test ID, item responses, or the fact that they took the test, with anyone. For example, if users want to share their test ID with a romantic partner, that partner will be able to access all of the user’s responses to the Test. Results filtering based on demographic data or an item response disclosed by a user could possibly allow the person they told to determine the user’s test results. For these reasons, we highly recommend that users only share that they took the test or their test ID number or item answers with people who have earned their trust. In the event that a user regrets sharing that they took the test, a test ID, or item response with others, The Briggs Institute, Inc. will not reassign a test ID or block others from accessing test responses associated with that test ID because we are not able to verify that a test ID is connected with a particular user. 

Payment information will indicate that a user has made a purchase on the Website. This information would indicate that a user likely took the Test but it would not provide any means for accessing a user’s test responses. If users are concerned about others knowing that they visited the Website and/or took the Test, we strongly recommend that they safeguard their financial records by not allowing others to access them.

Additional limits on confidentiality include threats to information security that are present whenever a user engages a device connected to the internet. All of us at The Briggs Institute, Inc. ask you to please remember that there is always a risk of a breach of confidentiality whenever you share your personal information. We also want you to be aware that your computer and other electronic devices may not be secured according to industry standards.

INFORMATION SECURITY CONSIDERATIONS

POTENTIAL BENEFITS AND RISKS

User experiences with the Website and the Test vary.

Since website and test content is often sensitive in nature, you may find that visiting the Website or taking the Test may trigger memories of unpleasant or traumatic aspects of your life; you may experience uncomfortable feelings like fear, sadness, guilt, anger, frustration, loneliness, helplessness, and other difficult emotions. 

If you decide to share your test results with others, they may not like your test results and may make judgements about you that could hurt your feelings or adversely affect your relationships with them or others.

The Briggs Institute, Inc. believes the potential benefits of the Website and the Test significantly outweigh the risks. Many people enjoy visiting the Website and taking the Test. Your experience with Sex Life Science services could also help you better understand yourself and give you information you could use to form better relationships, find solutions to specific problems, and significantly reduce feelings of distress related to topics addressed on the Website and Test. There are no guarantees, however, regarding your experiences with Sex Life Science services.

Throughout your experience with Sex Life Science services, you should evaluate your opinions of whether you feel comfortable with the Website and Test. Sex Life Science services require you to commit your time, money, and energy, so you should be careful about whether or not you decide to use Sex Life Science services. 

LOGIN SHARING PROHIBITED

In order to keep account information (e.g., payment info) secure, each person who takes the test is required to set up an individual membership account. The sharing of the same account by separate users is strictly prohibited.

ACCOUNT PURGING

Sex Life Science may purge (i.e., deactivate and delete) accounts for any reason, with or without notice. Common reasons why an account may be purged include, but are not limited to, inactivity and suspicious account activity.

VOLUNTARY PARTICIPATION

Your decision to use Sex Life Science services is voluntary. You can stop using them at any time and discontinuing use of them will not result in you being unable to resume use at a later date nor will it prevent you from seeking to engage with other services provided by The Briggs Institute, Inc. (e.g., therapy). 

NO WARRANTIES OR GUARANTEES

The Briggs Institute, Inc. does not provide warranties related to the information on the Website or in test results or in services provided by other professionals who use the Website and/or Test to inform their work with users. The Briggs Institute, Inc. does not guarantee that users will find the Website or the Test entertaining or informative. Furthermore, we do not guarantee that test results or Website information will help visitors or users improve their lives or relationships in any way. 

PAYMENTS AND REFUNDS

Purchases for all Sex Life Science services are final. The Briggs Institute, Inc. does not issue refunds for any purchases made on the Website unless required to do so by law. Furthermore, The Briggs Institute, Inc. is not responsible for technical difficulties with users’ electronic devices (e.g., phone or computer crashes, internet outages) even if those difficulties prevent users from fully utilizing a Sex Life Science purchase. 

TRADEMARKS

The Briggs Institute, Inc. and Sex Life Science logos and intellectual property on the Website are not to be reproduced or redistributed without the expressed written consent of an authorized affiliate, director, employee and/or agent of The Briggs Institute, Inc. 

WEBSITE AND THIRD-PARTY CONTENT

The Briggs Institute, Inc. and Sex life science is not liable for any loss or damage caused by a user’s experience or use of information associated with the Website or Test. It is the responsibility of users to evaluate the accuracy, completeness or usefulness of any information, opinion, advice, or other content available through the Website or Test. When appropriate, all of us at The Briggs Institute, Inc. and Sex Life Science recommend that users work with qualified professionals to assist in the evaluation of information, opinions, advice or content expressed on the Website or Test. 

The Briggs Institute, Inc. and Sex Life Science may distribute third party content on the Website or Test. In some of these cases, we do not have the right to edit this third party content. Any opinions, advice, statements, services, offers, or other information or content expressed or made by third parties are those of the respective creators (e.g., authors, distributors) and not of The Briggs Institute, Inc. or Sex Life Science. 

MISCELLANEOUS

This Agreement, our website, and our test are governed by the laws of Tennessee, without regard to its conflict of law principles. The City of Nashville, in which The Briggs Institute, Inc. is located, shall be the forum for any legal action relating to our website or test. Should any part of this Agreement be held invalid or unenforceable, that portion shall be construed consistent with applicable law and the remaining portions shall remain in full force and effect. To the extent that any aspect is in conflict or inconsistent with this Agreement, this Agreement shall take precedence. The failure of The Briggs Institute, Inc. to enforce any provision or right as found in this Agreement will not constitute a waiver of such provision or right. The use of section headings in this Agreement is merely for convenience and in no way limits or defines how this Agreement should be construed. This Agreement and any operating rules for the Website and/or Test constitute the entire agreement of the parties with respect to the subject matter hereof, and supersede all previous written or oral agreements between the parties with respect to such subject matter.
